Who Pays for Your Care After a Car Wreck in Arkansas? PIP, Med-Pay and Liability Explained

After a wreck, the question that keeps most people from getting checked out isn't "Am I hurt?" It's "Who's going to pay for this?" Here's how it usually works in Arkansas, in plain English.

We see it every week in Cabot. Someone gets rear-ended on Highway 67/167 or on Main Street, feels sore for a few days, and decides to wait it out. Usually that's because they assume a doctor visit means a big bill they'll be stuck with until the insurance companies sort things out.

In Arkansas, you often have more coverage than you realize. This article is general information, not legal advice. Your policy and your attorney, if you have one, are the final word.

Arkansas is an "at-fault" state, with a safety net

In Arkansas, the driver who caused the wreck (through their liability insurance) is ultimately responsible for your injuries. The catch is timing. A liability claim usually pays at the end, when the claim settles. That can take months.

That's why Arkansas law also requires auto insurers to offer Personal Injury Protection (PIP) coverage. PIP is part of your own policy and pays regardless of who caused the wreck.

What Arkansas PIP covers

Under Arkansas law, insurers must include PIP on auto policies unless you rejected it in writing when you bought the policy. The minimum PIP benefits include:

  • Medical and hospital expenses: at least $5,000 per person

  • Lost income: a portion of your lost wages if your injuries keep you from working

  • Accidental death benefit: for a covered person who dies as a result of the crash

Many policies carry more than the minimum. Pull up your declarations page, or call your agent, and look for "PIP" or "Personal Injury Protection."

Who's usually covered: you, people in your household, and passengers in your vehicle.

What if I don't have PIP? Check for Med-Pay

Some Arkansas drivers turned PIP down, often without realizing it, just to save a few dollars on their premium. If that's you, check for Medical Payments coverage (Med-Pay). It's a similar no-fault benefit that pays medical bills after a wreck, up to the limit you chose.

If you have neither, your options usually include:

  1. The at-fault driver's liability insurance: typically paid when your claim settles.

  2. Your health insurance: we accept many plans, including Arkansas Blue Cross Blue Shield, QualChoice, Ambetter, Medicare, Medicaid and more. See our insurance page.

  3. Care on a lien through your attorney: if you've hired a personal injury attorney, treatment can often be paid when your case resolves.

  4. Our affordable cash plans: see our financial information.

Does PIP cover chiropractic care?

Yes. PIP pays for reasonable and necessary medical treatment of injuries from the wreck, and chiropractic care is part of that. That typically includes the exam, X-rays when they are needed, adjustments, and rehabilitative care for injuries like whiplash, neck pain and back pain.

Why the paperwork from your first visit matters so much

Whichever insurance ends up paying, every adjuster asks the same question: are these injuries really from the wreck?

The answer comes from your records. That means an exam soon after the crash, documented findings, and consistent care with no long gaps. Dr. Luke is a Certified Personal Injury Examiner (CPIE), trained specifically to evaluate and document car-wreck injuries the way insurers and attorneys need to see them. We cover why that matters in Do I Need a Doctor After a Car Accident?

A simple checklist for the first week

  1. Report the wreck to your insurance company and get a claim number.

  2. Ask your agent: "Do I have PIP or Med-Pay, and how much?"

  3. Get evaluated, even if you only feel stiff. Many injuries take 24–72 hours to show up.

  4. Keep everything: the police report number, photos, the other driver's insurance information, and every bill and receipt.

  5. Talk to a personal injury attorney if your injuries are significant or the other insurer is giving you a hard time.

Common questions

Will using PIP raise my rates if I wasn't at fault? That depends on your insurer. Ask your agent directly.

The other driver was at fault. Why should I use my own PIP? Because it pays now, while the liability claim can take months. Your insurer can then seek reimbursement from the at-fault driver's company.

Do I need a referral to see a chiropractor after a wreck? No. In Arkansas you can see a chiropractor directly. More on that here.
